Bidders for this work will be required to comply with the President’s Executive Order Nos. 11246 as amended, 11518 and 11625 as amended. The requirements for bidders and contractors under these orders are explained in the specifications.

The City of Sioux Falls has adopted a Disadvantaged Business Enterprise Plan. This Plan expresses the commitment of the City of Sioux Falls that disadvantaged business enterprises have the maximum opportunity to compete for and perform federally assisted contracts and subcontracts.

The City of Sioux Falls has available the latest Disadvantaged Business Enterprise directory in the Finance Department to facilitate identifying those certified disadvantaged business enterprises within the state of South Dakota.

Bidders on this work will be required to comply with Title 40 CFR 33 and Executive Order 12138. The requirements for bidders and contractors under this regulation which concerns utilization of Disadvantaged/Minority Business Enterprises (DBE/MBE) and Women’s Business Enterprises (WBE) are explained in the specifications. The DBE/MBE and WBE goals for participation in this contract in terms of percentage of contract value are as follows: MBE 1.0 percent; WBE 4.0 percent.

WHEREAS, a hearing to determine that there is no feasible and prudent alternative to the proposal to demolish 1005, 1023, and 1027 S. Dakota Ave. and 414 W. 19th St. in the Sherman Historic District based upon the consideration of all relevant factors, and that the program includes all possible planning to minimize harm to the historic property resulting from such use came before the City Council at its normal meeting time on Wednesday, August 7, 2024; and

WHEREAS, the City conducted a public meeting, gave notice of the hearing as required by law, and gave consideration to all relevant factors; and

WHEREAS, at the conclusion of the hearing, a motion authorizing the proposal to demolish homes at 1005, 1023, and 1027 S. Dakota Ave. and 414 W. 19th St. in the Sherman Historic District with the condition that the Tre Living Apartment review, sale, and development occurs and the issuance of any related permits based upon the consideration of all relevant factors, and that the program includes all possible planning to minimize harm to the historic property resulting from such use at, passed with eight (8) votes for granting the motion and zero (0) votes denying the motion by the City Council; and

WHEREAS, thereafter the above-referenced motion, the City Council authorized the Sioux Falls City Attorney’s Office to prepare written findings consistent with said motion for discussion, review, and approval by the City Council;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:

That the recitals above are adopted as findings, and in addition, the following findings are adopted:

FINDINGS:

The proposal to demolish homes at 1005, 1023, and 1027 S. Dakota Ave. and 414 W. 19th St. in the Sherman Historic District shall hereinafter be referred to as the “Proposal.”

The Proposal impacts the Sherman Historic District which is listed on the National Register of Historic Places.

The Proposal was reviewed by the Board of Historic Preservation (BoHP) on June 12, 2024, at which time the Board determined that the Proposal, if approved, would not have an adverse effect on the Sherman Historic District.

The Proposal as reviewed by the BoHP included a structural analysis on the homes to determine their integrity for saving them.

On June 18, 2024, a case report regarding the Proposal was received by the South Dakota State Historic Preservation Office (SHPO).

On June 24, 2024, SHPO sent a letter to Diane deKoeyer with Sioux Falls Planning and Development Services that contained a determination that the Proposal would destroy historic property that is included in the National and State Registers of Historic Places; that the Proposal will encroach upon historic property; and that alternatives to the Proposal have not been adequately considered and should be further explored.

The applicant has requested the City Council to make a final determination on the Proposal.

Pursuant to SDCL 1-19A-11.1, the Sioux Falls City Council held a public hearing on August 7, 2024, to determine that there is no feasible and prudent alternative to the Proposal based upon the consideration of all relevant factors, and that the program includes all possible planning to minimize harm to the historic property resulting from such use.

The applicant has the burden to show the absence of feasible and prudent alternatives.

The City Council heard testimony and presentations from City staff and provided an opportunity for testimony from the applicant, proponents, and opponents of the Proposal.

The City Council’s review and consideration included, but was not limited to, the above-referenced testimony and presentation; the BoHP Staff Report and Tre Living Apartment Review; South Dakota Codified Law 1-19A-11.1; Summary of SDCL 1-19A-11.1 Review Process; BoHP Meeting Minutes for June 12, 2024; SHPO letter of June 24, 2024, and letter of July 12, 2024; SHPO SDCL 1-19A-11.1 Case Report; RISE Structural Associates Report from February 9, 2022; Apex Structural Design LLC report from August 10, 2018; Cost Estimate updated June 25, 2024; reasonable and prudent alternatives to the Proposal have been explored.

The applicant has shown an absence of a feasible and prudent alternative to the Proposal.

The properties subject to the Proposal could not be sold.

The properties subject to the Proposal could not be rehabilitated.

Rehabilitation of the properties is not possible due to technical, structural, and engineering considerations.

Restoration of the properties subject to the Proposal is economically imprudent.

The Proposal, if approved, would not have an adverse effect on the Sherman Historic District.

Based upon consideration of all relevant factors, there are no feasible and prudent alternatives to the Proposal, and the program has included all possible planning to minimize harm to the historic property resulting from such use, so long as the Tre Living Apartment review, sale, and development occur.

ORDINANCE NO. 73-24

AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AMENDING THE CODE OF ORDINANCES OF THE CITY BY REVISING CHAPTER 90: ANIMALS AND FOWL TO ALLOW HOBBY BEEKEEPING AT THE ZOO.

BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:

Section 1. That Section 90.100 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:

§ 90.100 PERMIT REQUIRED.

(a) No person shall establish or maintain any hive or colony unless the city issues a permit allowing the applicant to establish and maintain a colony on the property he/she owns. Exception: If the principal use of the property is a college, university, post high school, middle school, high school, or zoo, the application shall require authorization from the property owner or authorized agent. The permit will be valid for one year.

(b) Permits are nontransferable and do not run with the land.

(c) By signing the permit, the applicant acknowledges that he or she shall defend and indemnify the city against any and all claims arising from his/her hobby beekeeping. If the principal use of the property is a college, university, post high school, middle school, high school, or zoo, the property owner or authorized agent shall also acknowledge that they shall defend and indemnify the city against any and all claims arising from the hobby beekeeping on the subject property.

(d) The fee for the initial permit shall be $50. For each subsequent permit, there shall be a $25 renewal fee. The Sioux Falls Zoo & Aquarium shall not be required to pay for the initial permit or any subsequent permit.

(e) No permit shall be issued unless the applicant has registered his or her apiaries with the state as required by SDCL ch. 38-18, and complies with the applicable provisions of this code and SDCL ch. 38-18.

(f) The applicant must show proof of having successfully completed a beekeeping class not more than one year prior to the initial application. The beekeeping class must be from an organization approved by the city.

(g) Hobby beekeeping shall only be allowed on property that meets one of the following zoning classifications:

(1) A DD or AD1 form in any eligible zoning district.

(2) A OPEN2 form in the REC or S-2 Institutional Campus zoning district.

(3) A OPEN3 form in the AG zoning district.

(4) A BCF1 or BCF3 form in the S-1 General Institutional or S-2 Institutional Campus zoning district whose principal use is a college, university, post high school, middle school, or high school.

(5) A property in the S-2 Institutional Campus zoning district with no form established that is located within the boundaries of a school campus.

(h) If the property is a DD or AD1 form, the initial application must be accompanied by a written consent of 80% of property owners of all property situated within 100 feet of the applicant’s property, and 100% of all property owners abutting the applicant’s property. In all other forms, the hive(s) must be located at least 100 feet from any property not owned or controlled by the applicant or authorized agent.

(i) Beekeepers are subject to annual inspections conducted by animal control.

Section 2. That Section 90.101 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:

§ 90.101 STANDARDS OF PRACTICE.

(a) Honeybee colonies shall be kept in hives with removable frames, which must be kept in sound and usable conditions.

(b) Each beekeeper must ensure that a convenient source of water is available within ten feet of each colony at all times that the colonies remain active outside the hive, and the water shall be maintained so as not to become stagnant.

(c) Each beekeeper must ensure that no wax comb or other material that might encourage robbing by other honeybees is left upon the grounds of the apiary lot. Such materials once removed from the site shall be handled and stored in sealed containers, or placed within a building or other vermin-proof container.

(d) Each beekeeper shall maintain his or her beekeeping equipment in good condition, including keeping the hives painted if they have been painted but are peeling or flaking, and securing unused equipment from weather, potential theft or vandalism, and occupancy by swarms.

(e) A sign provided by animal control shall be displayed on a place clearly visible from the closest sidewalk, circulation area, parking lot or right-of-way to the hive(s), or in a location designated by the city. Said sign must warn the public as follows: BEE HIVE ON THIS PROPERTY. REPORT VIOLATIONS TO SIOUX FALLS ANIMAL CONTROL (605 367 7000). Hives located at the Sioux Falls Zoo & Aquarium are exempt from this requirement.

ORDINANCE NO. 74-24

AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, DECLARING CERTAIN REAL PROPERTY OF THE CITY SURPLUS AND AUTHORIZING THE TRANSFER OF CITY PROPRTY.

BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:

WHEREAS, Notwithstanding the provisions of SDCL Chapter 6-13, and pursuant to Section 2.12(7) of the City Charter, the City of Sioux Falls hereby declares the following property to be surplus property that is no longer necessary, useful, or suitable for the purpose for which it was acquired:

Tract 1 of Minnehaha County Power Addition in the SE1/4 of Section 35-T104N-R50W of the 5th P.M., Minnehaha County, South Dakota.

WHEREAS, in 2007 City and County, having common interests and responsibilities to provide public safety communications within Minnehaha County and the area in and around the city of Sioux Falls, entered into a Joint Cooperative Agreement for Communication Services (“Cooperative Agreement”) under which the parties created Metro Communications Agency (“Metro”) pursuant to SDCL § 1-24-4(2); and

WHEREAS, the Cooperative Agreement was revised as the First Amended and Restated Joint Cooperative Agreement for Communication Services (effective January 1, 2011); and

WHEREAS, City and County have determined that it was in their mutual best interests to terminate the Cooperative Agreement, as amended, and have entered into a new Joint Cooperative Agreement for Emergency Communications Services, under which the parties agreed that Metro ceased to exist as a separate legal entity effective as of January 1, 2024, and would thereafter be an office under the City; and

WHEREAS, SDCL Chapter 1-24 authorizes public agencies, including counties and municipalities, to jointly exercise any powers, privileges, or authority that such public agencies are capable of exercising on their own; and

WHEREAS, SDCL Chapter 6-5 authorizes counties and municipalities to exchange with each other and to transfer and convey from one to the other any land or property belonging to them and to perform and exchange work between themselves, and pursuant to SDCL 1-24-2 such authority extends to a separate legal entity created under SDCL Chapter 1-24; and

WHEREAS, SDCL Chapter 34-45 authorizes the governing bodies of two or more public agencies to enter into an agreement for the provision of a 911 system; and

WHEREAS, that the Mayor is authorized to sign the attached “Transfer Agreement West Baltic Tower Site” on behalf of the City, any and all documents necessary to make the transfer and conveyance of the above-described property between the City of Sioux Falls and Minnehaha County, pursuant to and subject to all other conditions and terms and as set forth in the “Transfer Agreement West Baltic Tower Site.”

WHEREAS, the City shall publish this ordinance, without attachments, after its passage. The attachments are on file and available for inspection in the office of the City Clerk.

AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AUTHORIZING THE ISSUANCE OF ITS WASTEWATER SYSTEM REVENUE BOND TO THE SOUTH DAKOTA CONSERVANCY DISTRICT, AUTHORIZING THE USE OF THE PROCEEDS THEREOF FOR CAPITAL IMPROVEMENTS, PLEDGING THE WASTEWATER SYSTEM REVENUE OF THE CITY TO THE PAYMENT OF SAID WASTEWATER SYSTEM REVENUE BOND, FIXING THE TERMS OF SUCH WASTEWATER SYSTEM REVENUE BOND, AUTHORIZING THE EXECUTION AND DELIVERY OF A LOAN AGREEMENT BETWEEN THE CITY AND THE SOUTH DAKOTA CONSERVANCY DISTRICT, AND AUTHORIZING THE EXECUTION AND DELIVERY OF SUCH WASTEWATER SYSTEM REVENUE BOND TO THE SOUTH DAKOTA CONSERVANCY DISTRICT NOT TO EXCEED $11,000,000.

BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:

WHEREAS, the City currently operates a wastewater system and has determined that improvements to the wastewater facilities are necessary and qualify as an improvement, extension, or addition to its wastewater system; and

WHEREAS, the City of Sioux Falls (the “City”) is authorized by its City Charter (the “City Charter”) and by Chapters 9-40 and 6-8B of the South Dakota Codified Laws to issue wastewater system revenue bonds to finance the acquisition of capital improvements to its wastewater system in anticipation of the collection of wastewater system revenues; and

WHEREAS, the City is authorized by its City Charter and Chapter 9-48 of the South Dakota Codified Laws (“SDCL Chapter 9-48”) to establish just and equitable rates of charges to be paid to such City for the use of the wastewater system of the City, directly or indirectly; and the City has adopted and enacted City of Sioux Falls Ordinance No. 43-23 pursuant to its City Charter and SDCL Chapter 9-48 which Ordinance establishes charges for the use of the wastewater system of the City; and

WHEREAS, the City has determined that the improvements described in Exhibit A (the “Project”) are necessary for the conduct of the City’s operation of its governmental programs and qualify under its City Charter and Chapter 6-8B of the South Dakota Codified Laws (“Chapter 6-8B”) as improvements that may be financed through the issuance of the Bond; and

WHEREAS, the South Dakota Conservancy District (the “District”) has established the South Dakota State Revolving Fund Loan Program pursuant to SDCL 46A-1-49 (the “Program”) whereby participating public entities, by issuing their bonds to the District, may acquire necessary improvements and reduce the interest and issuance costs of the public entities below what could be achieved if the improvements to be acquired by each public entity individually were to be financed and acquired separately; and

WHEREAS, the City desires to finance $11,000,000 of the costs of the Project through a loan from the Program under the terms of a loan agreement in substantially the form attached hereto as Exhibit B (the “Loan Agreement”), such loan to be evidenced by a Wastewater System Revenue Bond, Series 2024C, in the amount of $11,000,000 (the “Bond”); and

WHEREAS, it is in the best interests of the City to participate in the Program, to authorize the borrowing of funds from the District for the financing of the Project by authorizing and issuing its Wastewater System Revenue Bond to the District with the terms approved hereby for an aggregate sum not in excess of $11,000,000 and to pledge the net revenues of the City’s wastewater system as security for the repayment of such Bond;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD, THAT:

Section 1. Findings.

(a) The City desires and hereby determines it is necessary to improve its wastewater facilities by undertaking the Project. The City hereby expressly finds that if the Project is not undertaken, certain deficiencies in the wastewater system will pose a health hazard to the City and its inhabitants who are served by the City’s wastewater system. Because of the functional interdependence of the various portions of the wastewater system and the nature of the improvements financed, the City hereby determines that the Project will substantially benefit the entire wastewater system and all of its users within the meaning of SDCL 9-40-15 and SDCL 9-40-17. Therefore, the City hereby determines that for the purposes of the Act, including, in particular, SDCL 9-40-17, the net income or revenues of the entire wastewater system, as extended, added to, or improved by the Project shall be deemed to be the net income or revenues available to be pledged to the payment of the Bond issued hereunder.

(b) The City finds that it is desirable and expedient to participate in the Program and to authorize and deliver the Loan Agreement and to authorize, issue, and sell the Bond to the District as provided herein and in the Loan Agreement.

Section 2. Authorization. The Loan Agreement and the issuance of the Bond are hereby authorized and approved, with said Bond to be issued on a parity basis, in the aggregate principal amount not in excess of the $11,000,000 with the terms and subject to the provisions as set forth in the Loan Agreement. It is further authorized and approved to secure the repayment of the Bond with a pledge of the wastewater system revenue, as set forth in the Loan Agreement.

Section 3. Execution of Documents. In connection with the authorization, issuance, and delivery of the Bond, the Mayor, City Clerk, Finance Director, City Attorney, and other officers of the City shall be authorized to enter into, execute, and deliver the following documents, instruments, and agreements as may be deemed necessary or appropriate by such officers and the District, consistent with the terms of this Ordinance:

(A) The Loan Agreement providing for the issuance of the Bond and setting forth the terms thereof;

(B) The Bond; and

(C) Such other documents, agreements, or instruments as may be necessary to make covenants and recite facts required to demonstrate the validity and enforceability of the Bond under the laws of the state of South Dakota and to assure the exclusion of the interest thereon from the gross income of the owner of the Bond under the Internal Revenue Code of 1986, as amended, and to effectuate the terms and intent of this Ordinance.

The execution and delivery of the Loan Agreement, the Bond, and all such other agreements, documents, and instruments as necessary and appropriate are hereby authorized, all of which to be in substantially the form on file with the City on the date hereof and with such necessary and appropriate variations, omissions, and insertions as are consistent with the terms of this Ordinance as determined by the Mayor in consultation with the City Attorney.

Execution and delivery of such documents by the Mayor, Finance Director, and/or City Attorney shall constitute evidence that such documents are consistent with the terms of this Ordinance and the items have been duly authorized, executed, and delivered by the City and are enforceable against the City in accordance with their terms, subject to customary exceptions relating to bankruptcy, reorganization, insolvency, and other laws affecting creditors’ rights. The Mayor, Finance Director, and the City Attorney are further authorized to take such other actions as may be required to effectuate the terms and intent of this Ordinance.

Section 4. Severability. In case any one or more of the provisions of this Ordinance, the Loan Agreement, or the Bond authorized hereby shall for any reason be held to be illegal or invalid, such illegality or invalidity shall not affect any other provision of this Ordinance, the Loan Agreement, or the Bond, but this Ordinance, the Loan Agreement, or the Bond shall be construed as if such illegal or invalid provision had not been contained therein.

Section 5. Satisfaction of Conditions Precedent. All acts, conditions, and things required by the laws of the state of South Dakota, relating to the adoption of this Ordinance, to the issuance of the Bond, and to the execution of the Loan Agreement and the other documents referred to above shall be satisfied prior to the issuance of the Bond. The designated officers are hereby authorized to do all acts and things required by them under this Ordinance, the Loan Agreement, and the other documents referred to above for the full, punctual, and complete performance of all the terms, covenants, and agreements contained in the Bond, the Loan Agreement, the other documents referred to above, and this Ordinance.

Section 6. Publication and Effective Date. After passage, this Ordinance (except for Exhibit B hereto which is on file and available for inspection in the offices of the City Clerk) shall be published in the City’s officially-designated newspaper, and will be effective on the 20th day following such publication, unless suspended by referendum in accordance with Chapter 9-20 of the South Dakota Codified Laws. After becoming effective, this Ordinance will be irrepealable until the Bond issued hereunder has been paid in full, except that prior to issuance of the Bond, this Ordinance may be amended in accordance with South Dakota law.

Section 7. Prior Resolutions. All prior resolutions or ordinances that conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.

UNAPPROVED MINUTES BALTIC CITY COUNCIL MEETING

August 13, 2024, 7:00 PM BALTIC CITY HALL 130 ST. OLAF AVENUE BALTIC, SOUTH DAKOTA

Mayor Deborah McIsaac called the meeting to order at 7:04 PM in the Baltic City Hall, 130 St. Olaf Avenue. Answering roll call were City Attorney John Hughes, Aldermen Ryan Sinding, Mayor Deborah McIsaac, Alderman Nikki Oien and joining via Teams, Alderman Steve Boeve. Listening on the phone as a guest was Alderman Brian McGreevy. Also, in attendance was ISG Engineer Justin Heim and Parker Hamann, Public Works Supervisor Ryan Fods and Finance Officer Lacey Harrington.

Mayor McIsaac led the meeting in the Pledge of Allegiance.

The council reviewed the July 9th, 2024 Regular Council Meeting minutes. Ryan Sinding made a motion to approve the July 9th, 2024 minutes, Nikki Oien seconded. All ayes, motion carried.

Council reviewed the Claims Payable. Sinding made a motion to approve the Claims Payable and Nikki Oien seconded. All ayes, motion carried.

Public Time

Debbie Murphy came forward to thank the City of Baltic and everyone involved in the events for a successful Dog Days.

Calvin and Hannah Ruffey came forward wanting to discuss their property line and mowing the boulevard, and whethere they are required to do so. Mayor Deborah McIsaac explained that the State of SD allows municipalities to be able to govern and manage all private land and public land and allows city to ask abutting properties to take care of those spots including mowing, weeds, snow removal. Baltic citizens maintain their abutting property/boulevard. Ruffey asked what non-mowing options he had for the boulevard. Ryan Fods advised that the Planning & Zoning regulations require those areas be landscaped with sod, seed or other living ground, there was discussion about types of vegetation that would help minimize the mowing and still look nice. Mayor advised before planting anything, to check with ordinances and regulations on what is allowed.

Desiree came forward to asking about peeling paint and how soon it would need to be remediated if the Code Enforcement Officer would send her a letter. The Mayor explained that our Code Enforcement Officer is easy to work with and we just ask citizens to communicate with him on their plans and a timeline and he would accommodate those plans.

OLD BUSINESS

Bulldog Avenue

The Baltic School District would like Bulldog Avenue to go back to a 2-way street. Ryan Sinding made a motion to put Bulldog Avenue back from a 1-way to a 2-way effective immediately, Nikki Oien seconded, all ayes, motion carried.

Veterans Memorial

Mayor McIsaac asked if there have been any updates on this. Lacey Harrington advised we have not heard anything regarding the memorial. This has been tabled until we have more information and updates to discuss.

Verizon Wireless

April 2023, the Verizon Wireless Agreement was approved, but the work hadn’t been completed. A new agreement was asked to be signed within the current fiscal year. Nikki Oien made a motion to give Mayor Deborah McIsaac approval to sign the new agreement with Verizon Wireless, Ryan Sinding seconded, all ayes, motion carried.

City Hall destruction and Fines and Fees are tabled until further updates.

NEW BUSINESS

Public Hearing - Re-Plat Request – Prairie Avenue

Mayor Deborah McIsaac asked if anyone was present to speak on behalf of the public for the re-plat of Prairie Avenue lots 54, 55, 56, 57, 58, & 59 in the Valley View Meadows Addition.

No one came forward.

Ryan Fods presented the Council with the request from M&L Construction to combine lots 54 & 55 to create lot 54A, combine lots 56 & 57 to create lot 56A & combine lots 58 & 59 to create lot 58A with Planning & Zoning commission approval. Ryan Sinding made the motion upon recommendation of the Planning & Zoning Commission, to give Mayor Deborah McIsaac permission to sign the mylars to combine lots 54 & 55 to create lot 54A, combine lots 56 & 57 to create lot 56A & combine lots 58 & 59 to create lot 58A, Nikki Oien seconded, all ayes, motion carried.

ENGINEERING UPDATE

Watermain Looping Project

Justin Heim with ISG stated the Watermain Looping has been hold for a couple of weeks. Presented a change order to include the installation of public sanitary sewer along 4th Street. The installation of sanitary sewer in this area will provide more conformity within the system providing less maintenance resiliency for the public infrastructure. The cost of this change order is not eligible for the grant funding as it was not included in the original scope of work for the SRF funding. It is recommended to complete the work at this time to capitalize on the efficiencies of having a contractor on site to complete the work. Justin discussed this will cause some service disruption during this and how they plan to accommodate the citizens getting in and out during that time.

Oak & Ash

Justin gave updated on the Oak and Ash Project. Heim informed the Council that Lovely Avenue was completed this week and they have moved on to Ash and will move on to Oak as well. They are still planning on completing this project this fall depending on weather. A Pay Application was presented. Alderman Sinding asked Heim how many change orders are there going to be and wanted to show concern for those change orders in terms of cost to the city. Heim explained it is normal to have these change orders and they like to present the Council with change orders as they come to be transparent. He also informed the Council they are still under that overall engineers estimate on the project.

Nikki Oien made a motion to approve the Pay Application #3 for $120,044.85, Steve Boeve seconded, all ayes, motion carried.

Nikki Oien then made a motion to approve Change Order #1 for $62,627.16 for the Watermain Looping Project change order, Sinding seconded, all ayes, motion carried.

Nikki Oien then made a motion to approve Pay Application #2 $97,255.31 for the Oak & Ash Utility Improvements Project, Sinding seconded, all ayes, motion carried.

ISG Engineer Justin Heim asked for a motion to approve ISG to go to bid with Ryan Fods help for the Main Lift Station Improvements Project this September. Ryan Sinding made a motion to approve ISG and Ryan Fods to go to bid for the Main Lift Station Improvements Project, seconded by Nikki Oien, all ayes, motion carried.

Baltic Heights Park

Mayor Deborah McIsaac gave updates on the Baltic Community Access Grant and the Transportation Alternative Grant. Mayor McIsaac discussed options on funding for the Baltic Heights improvements as we were not selected by Game, Fish and Parks for a grant we has been looking into for pickleball, splash pad and other improvements.

PUBLIC WORKS UPDATE

Fods updated the Council on the Transportation Alternative Grant stating there would be a site visit Wednesday, August 14th. Fods reminded the Council of the Hwy 115 Project. For each of the meetings, if you want to be a stakeholder, they would like us there 30 minutes early. Fods signed us up for the Dell Rapids early. Everyone is welcome to attend. They are going to provide information on improvement projects over the next 5-10 years.

FINANCE UPDATE

Annual Budget

Lacey Harrington stated a date needs to be set for the Annual Budget. Harrington will get that date organized and notify the public.

Coffee with Council

Along with the budgeting, the date will be set and communicated to the public.

COMMUNITY RELATIONS UPDATE

Lacey Harrington gave recap of Dog Days. A post event meeting will be planned. Harrington also wanted to remind everyone about the lead pipe survey that we are required to have every property submit in Baltic. Letters will be sent to every household and business. All need to be completed as soon as possible otherwise the Public Works Dept will need to go to the remaining homes.

LEGAL/COUNIL/MAYOR/UPDATE

Attorney Hughes wanted to mention IM 28 that will be coming up to vote on. Ballot Measure IM 28 deals with a potential repeal of the state sales tax on anything for human consumption which could include tobacco. Mayor McIsaac and Attorney Hughes spoke in detail about the way this may affect the City of Baltic and its budget. Both McIsaac and Hughes wanted to remind voters to educate themselves before voting.

Attorney Hughes provided an update on the Settlement Agreement with Grant Park Capital. He presented the Council with a letter of response he had sent on July 12, 2024 to theGPC’s letter and check that was received on July 3, 2024. There has been no response from Grant Park. Hughes recommended we post this most recent update on the City of Baltic Website under the litigation link.
