[fl] Can A Forced Sale Through Magistrate Be Canceled Under Any Conditions?

Card image cap

Relatives had to force the sale of a property owned by an elderly mother and her son. Mother needed money for memory care unit, daughter has power of attorney and has been caring for the mom. Her brother, the other owner of the property, didn't show up to any of the court stuff so he lost.

Magistrate appoints realtor, home goes under contract. 5 days prior to closing, brother dies. Buyers find out and cancelled their offer.

Given the fact that the brother passed away, can the daughter file something so she doesn't have to go through the magistrate now since the sale isn't being contested? We would like to explore other options than selling now, like an equity line.

Thanks for any help
