[fl] My Wife Is Still On Her Ex-husband's Mortgage Because He Hasn't Refinanced The House Yet. What Steps Do We Need To Take To Get The Process Forced To Be Started?

My wife and her ex-husband separated in early 2021. We started dating in late 2021. By the end of 2022, we wanted to get married but they were still legally married. It took me pushing her ex-husband to finally sign the divorce paperwork for the divorce to get started.

In the divorce decree, it is stated that she no longer has any rights or wants to the house. I know in Florida that doesn't mean much.

Basically, multiple times now he has not paid the mortgage on time and it is hurting her credit and, in turn, hurting our new family's future. We are wanting to buy our own house. We are wanting to move. But we feel really stuck.

We have told him many, many times to refinance the house out of her name. He hasn't. He can't get approved by himself. He can't get approved with his mom. He can't get approved with his brother. (Mostly because he works a minimum wage job and has tremendous credit card debt).

What option do we have? We are at the point of forcing him to sell the house. The only reason we didn't is because of my wife and his shared child, my stepdaughter, having a place when she has visitation with him. But we are past caring about that.

So, basically, what is our next step? It feels like going to court is the only option but is there just papers that can be served instead to force a sell of the house since he can't refinance it? Is there a way to have the mortgage company just remove my wife from it?
