[florida] Workers (hired By My Hoa) Cut Down My Magnolia Tree And It Fell On My Car.

I live in a townhome subdivision and our HOA maintains the landscaping, including deciding when to cut down our trees, apparently. We were given no notice that our tree was going to be cut down. We were sleeping and woke up to find the tree gone and my car’s rear windshield destroyed.

We spoke to one of the workers and he gave us his company’s insurance information. We called them and asked them for a tow truck to take the car away, we asked them for a rental car, we asked them for any timeline on next steps and they gave us no information and just kept telling us that they couldn’t do anything until the damage was assessed, and did not tell us when that might happen.

We have photos of the damage and we have video (from our neighbor’s Ring camera) of the tree falling, as well as video from the aftermath at two different angles, but no video of the actual impact.

I want to know if I should wait for the insurance to help or hurt this situation, or should I pursue another course of action?
