[ny] My Employer Isn’t Giving Me Health Insurance Despite Stating They Would Provide It In The Employment Offer

Basically what the title says. I started a new job at the end of September 2024 at a health related nonprofit. The employment offer that I signed stated that I would be provided with health, dental, and vision insurance after a 90-day probationary period which ended around the beginning of January. I reached out to my employer around early December to start the enrollment process for the benefits, and they connected me with a ‘Medical Enrollment Specialist’, who enrolls employees of the NGO for insurance. The person I spoke to did not know how to enroll me for health insurance through my company, but they said that most likely I would have to pick a private plan from the market and my employer would reimburse me, but she didn’t know what amount.

I reached out to the director of the nonprofit and she wasn’t much help either. She first said she would figure it out and call me back, but then never did. When I called her again a week later, she said there was an update but that she would call me back. I didn’t hear from her after that, and followed up over email because it started to feel like I wouldn’t get insurance and wanted written documentation of her response. However, she didn’t respond to my email or any follow up emails I’ve sent after. I know that this is definitely illegal to walk back on their offer of health insurance after I’ve signed on to the company, but I’m wondering what the best course of action is to either get insurance or hold them accountable. I was recently unenrolled from Medicaid because my new income makes me ineligible, but now I do not have insurance. Do I sue them? Should I quit my job so I can be eligible again? Would I be able to get unemployment if I quit but it’s due to a breech in contract? I’m really frustrated and don’t know what the best route is at this point.
