(ny State) Husband Filed For “emergency Custody” Of Our Baby After Cheating

Sorry for the long question but I am trying to give as much information as possible since it’s Saturday and no attorneys are available today.

Late last night I got served that my husband is filing for emergency custody of our child after I caught him cheating. I went to stay with my parents about 3 hours away.

I have all the proof of him cheating, including text messages and phone calls to his ex. Even saying, “I want to pursue a relationship with you.” All while I was home taking care of our 1 year old.

I have been with my parents for about a month now, and I never deny him rights to visit the child. I do not drive unfortunately so he does need to make the trip. In fact I even encourage him to see the baby more.

I do not have enough money to even have a lawyer at this time, and the court date is next week.

Also, it’s very hard to get an attorney because the court date is 3 hours from where I currently am now, so all the attorneys I am familiar with will not make the drive, especially on this short notice!

I am so scared to get the baby taken away, as he never has been alone with the baby (at this request - he suffers from extreme depression and is HEAVILY medicated, and has been in and out of mental hospitals for the better half of his youth).

Does anybody have any give for me? I can’t stop crying a river and I have no idea what to do, given my financial situation.
