[strata In Bc] Requested A Council Hearing 1 Month Ago And Still No Response
I've had an ongoing issue with a noisy neighbour with whom I share a wall - she runs her laundry machine 10-12 hours a day EVERY day (literally) right up against the shared wall, and the noise is very loud. It can be heard throughout the apartment and, at this point, I only cope by wearing earplugs, running a white noise machine, and playing soft music all day long. I've spoken with her directly to try and resolve the issue to no avail. After that, I also submitted two formal complains to strata about bylaw and rule violations, and they were only effective at getting the neighbor to stop running laundry during quiet hours but the noise is still persistent throughout the day (morning, afternoon, evening.)
Long story short, I request a council hearing one month ago and got a response from the property manager suggesting I'd need to wait until Jan/Feb due to the holidays. The Strata Property Act does state "the strata council must hold the hearing within four weeks of the request" but I was willing to wait until January. So far, I have received no response as to a date for the hearing.
My questions are:
- At what point do I consider going to the CRT for the lack of strata response on the hearing? Is their lack of response after one month acceptable?
- If I do get a hearing, what can I expect to have recorded in council meeting minutes? What level of detail is typically captured?
