(va) Landlord Is Trying To Evict, But Took Payment Of This Month’s Rent And Is Now Asking For Background Check To Sign New Lease.

Here’s the situation: My boyfriend’s and his wife separated and she moved out in the middle of their lease. I moved in. The landlord was aware that she left and I stayed frequently. There’s been some issues with the property and the upkeep- a whole situation where I fell through the floor due to neglect of water damage by the landlord. The landlord lives in Texas. At the end of February the lease was up for my BF (the one that had his wife on it) and the landlord didn’t offer renewal or anything. We were going to move, but our new housing fell through at the last minute. After a lot of back and forth with the landlord (where he filed eviction paperwork with the court) he accepted march’s rent and said that he would agree to an 3 month lease with a credit and background check for me. The issue is that I have a criminal record (drug possession and larceny) but it’s all 7 years or older. I have an eviction from 10 years ago as well. My BF is worried that he will just try to evict based on this- but, he’s allowed me to live here for the last year. Should the lease just be in my BFs name? And if he accepted payment already, will the court evict us?
