180 Days Have Passed And No Indictment
I was arrested back in April for a BS domestic violence against a roommate in Texas (They considered it a felony). Basically the guy is not all there mentally and was getting kicked out and by the landlord and so he got mad and made a false claim against me.
It has now been 8 months, it has never gone to a grand jury, I have never been to court, and there has been no progress on this in any way.
My understanding is that after 180 days, they can't charge me and the case is to be dropped due to my right to a speedy trial, and that if it isn't dropped, it will automatically drop off at the end of the calendar year (12-31).
Is my understanding of this accurate, or am I going to have more problems with this next year? Because as of now, I can't pass a background check, and it is getting really frustrating.
Can anyone set my mind at ease regarding this? Thank you.
