Ac Company Destroyed Our Home During A Merger & Now Does Not Want To Do Anything Under New Llc
I'll try and keep it as short as possible
Essentially we bought a home new to us December 2023, and it was built in the 80s. We wanted to refresh the home so we got new carpet, we of course got new furniture, and wanted to get the ducts cleaned. Well we had one company come out and they let us know they couldnt do it because it was all fiberglass duct board, and we'd need to get them replaced as cleaning with a brush is risky. So we start getting quotes as we had no idea what duct replacement costs. And at this time it wasn't a need thing, we were living there comfortably, just to get an idea of what the prices were to save for it if we went down that road. So first company comes out, and the tech looks and says the ducts look fine, but they can clean them safely, don't worry about replacement. $650 and they can clean them with no issues, no brushes etc would be used at all. So I thought cool, lets do that if they can safely do it.
Day of the cleaning the tech they sent out couldnt speak english or communicate with me at all. I let him get setup and go in the garage to work. I check in on him a while later when hes halfway through and hes using a rotor brush just like they said they would not do. So I call the manager, let him know this isnt what i was promised, and he said it would be okay, to just let them finish.
So I did, my girlfriend and I went to the movies, and then came home. About 2am we wake up not able to breath, lungs on fire. At some point the heat kicked on, and the particles in the air were brutal. Went to the ER, got breathing treatments and an inhaler. I called the company again and let them know what was happening, and they said they needed to blow it out and to run it for a day, and then spray some stuff in the ducts to seal it. Well that made things even worse, there was visible piles of crap on everything under every vent, if you took off the vent grates you could see fiberglass particles etc. We tried staying there best we could, we decided to not use the central air in hopes it would improve, but despite how much we vacuumed or washed things, we kept getting nose bleeds, our lungs were irritated, we felt sick 24/7, it was a disaster. We finally both had to move out because it was so bad.
Anyways the company offered no help at all, and I now know why. They did open an insurance claim for us on our behalf, but that went no where as they had improper coverage for this issue (And yes we did have an attorney handle the insurance for us).
The issue is they had a total pollution exclusion, as well they were in the process of a merger during the event, that closed just 2 weeks later, the old company didnt care as they were selling anyway, and the new company doesnt feel the need to fix it (even though its the same name etc, just different LLC). They still operate as the exact same company. Insurance has been a pain since even though we can prove damage, they're not really protecting anything anymore, the assets are in the new LLC, and even though we're in the right, insurance has nothing to protect.
My issue is they also have a 100% satisfaction guarantee, and they are still honoring all past warranties, literally to all the good customers nothing has changed for them. The business still has all the same equipment, employees, logo, google reviews etc. The new company just says they only bought the assets, and its a new LLC with a DBA for the original name. But if they have a satisfaction guarantee and are honoring old warranties, shouldnt I still be helped?
The old business has pretty much wiped their hands of it, and the new company won't even talk to us. I'd definitely like to somehow implicate the new business as it happened at the end of the deal, and there's no way they didn't know about it when it was happening, there's no way they weren't already involved in the business in some way. But it's pretty crap for a company to be able to do so much damage, and somehow get out of it in this manner if they are able to.
Hopefully you guys have some ideas, because we need some help
