Accidental Recording In A Two Party Consent State In Healthcare Facility?

Card image cap

When I was in a New Hampshire ER a few weeks ago, I was out of the room being taken for scans. 2 or 3 nurses, had been going through my phone looking for medical and identitying information when (I'm assuming) they accidentally triggered the audio record button. Later in the ER, I found my phone in my ER room with my clothes. So I don't know if they were in my room going through my phone or if they took it out to the nurses station or something, but the recording was loud and clear, they were clearly just a few feet away from my phone. I won't go into details, but the things they said included bad unprofessionalism, breaches of confidentiality, swearing calling me (the patient) names, and more. (All of this triggered by nothing that I did because I had come in unresponsive and incapicatated.) In terms of going to the medical board for a formal complaint, is this doable without consequences being that they accidentally recorded themselves on my phone?? What if I had been the one to purposely record them? How would the two party consent law play into potential litigation?
