Advice For Grandparent To Claim My Child On Their Taxes

Card image cap

United states / Kansas

I am the sole custodial parent, For the entire year of 2024 I have lived with my mother due to domestic violence circumstances with my Ex. I want her to claim both of my children on her tax returns. What form do i need and how do i submit it?

My ex-partner is threatening to claim both of the children on his taxes, which he is not legally able to do anymore due to losing custody.

-We were never married

-We never lived with each other (In the eyes of the state I was custodial parent before the court order because they lived with me.)

-prior to DV, there was no actual custody order

-PRIOR to 2024 before DV, I would fill out Tax Form 8332 for him to claim the children so he could get the tax credit, which was only for the last two tax years, he thinks because of this tax history that he will be able to claim the children for his own benefit.

I personally cannot claim the children on my taxes this year because I was a stay at home parent prior to DV, I checked and they wont let me file due to no income, so i wouldn’t get the child tax credit (hence why I am having my mother claim them.)

What form do I need to give her permission, and how would i submit it to the IRS?
