Advice On Writing A Parole Protest Letter In Texas

I currently have a brother who is incarcerated for aggravated assault with a deadly weapon. Originally his crime was committed in January 2017, apparently all he did was threaten to hit someone with a tire iron but didn't actually do it. There were extra details to the story though like him and his friend luring their victim and his friend being in possession of a gun that was used to fire threatening warning shots. Despite all of that, he later received probation.

He struggled with alcohol and other addictions that have led to very poor decision making and impulse control. Several months later, in November, he violated the terms of his probation by committing yet another felony assault but this time on me. I tried to stop him from leaving in a vehicle highly intoxicated and he was very displeased with that. He tackled me, pinned me down and had me in a chokehold in front of three other witnesses. That charge was originally domestic violence while impeding breath or something like that.

The whole ordeal was extremely distressing since I have a chronic condition with my neck due to a severe car accident that makes my body have a lot of stroke like symptoms. Hurting my neck is serious and it was a fact my brother was fully aware of. (History of a Vertebral Artery Dissection if you want to research the specifics.) It was enough to violate him and led to him being sentenced to 10yrs in TDCJ. At the time of trial, I was pregnant and uninterested in continuing to testify when it wouldn't give him anymore time behind bars so they lowered the charge to a Class A misdemeanor of Assault Causes Bodily Injury to a family member. The DA was very pleased with the sentence and seemed content with my choice to not want to testify anymore. In 2023 he went up for Parole but was thankfully denied. The reasons for denial that were sited were his criminal history and the nature of his crime. However, spring of 2025 is approaching and so is another chance for parole. I have been strongly contemplating writing a letter to the parole board to request that his parole be denied because I do not feel that he has changed or been rehabilitated yet.

He is the father of two girls. I am raising his 16-year-old daughter and I am the godmother to his 7-year-old daughter who is on the spectrum. He doesn't reach out to speak to either of them unless it is to ask the adults in their life for money. Never once has he sent either of them a birthday card, Christmas card or just a simple letter because he claims he can't get stamps in there but he has been in trouble and received consequences for having tattoo equipment in his cell before. Some how behind bars he has continued his adulterous ways playing with womens emotions like cheating on the mother of his youngest. While hes a grown man and can do what he wants, it shows hes still addicted to drama and instant gratification. I dont believe he is rehabilitated enough to integrate into society yet. Most recently, he has secretly married someone his children don't even know. It's suspected that they think this marriage will help him look favorable to the parole board.

Would me writing to the parole board be a waste of time? What should I say to them? If he was a changed man, I would be here writing and asking for advice on how to help persuade them for his freedom but at his core, I believe he would be the same person if he were to walk out this year. I believe the judge and the DA knew what they were doing when they sentenced him to 10yrs, and we would be doing the community a disservice to go against that.
