Apartment Complex Accused Husband Of Dealing Marijuana And Requested Medical Records
This is surreal. I am a pharmacist and he is a professor, so both doctors. We live in Virginia, where weed is legal recreationally. We are allowed to grow 4 plants and possess in our home. Which we do both. The apartment complex came in to do a sprinkler inspection, the maintenance came in, then reported us to the office.
They contacted my husband, told him that he possessed a “large quantity” of marijuana and that he was not allowed to sell and distribute. So accusing him of illegal activity. He explained that he was within his right to grow and possess per the Virginia law.
She then asked him to prove he needed to use marijuana for a medical purpose by requesting his medical card. That is protected medical information and not at all required. It is totally legal to grow up to 4 plants and possess at home for recreational, without any need to have a card. You can gift up to an ounce even! If they had concern that we were in any way doing something illegal she could have contacted authorities, who would have explained that we are within our rights to possess, in our residence, marijuana. Also please note that we are able to smoke per the handbook, there is nothing stating any limitations.
She accused us of a felony and asked for protected health information. What recourse do we have?
