Are Landlords Required To Provide Snow Removal/safe Conditions In Parking Lots/driveways?
I rent a space in a warehouse building in upstate New York. I am unsure of the official zoning- I looked up the property on loopnet and it just said X. I was using this space for my art studio, not living there, and I do not think it’s zoned as a residential building (although people definitely do live there).
I am in the process of moving out and hired a moving company. When they arrived they said that the driveway and parking lot were not safe due to the amount of snow and lack of any salting. While we were talking a car actually did get stuck trying to get out and we had to help them, and I’ve seen multiple other cars get stuck as well.
The original moving date was 12/23 so I’d be out by the end of December, but the movers couldn’t get me back in until 1/10. (Moving by myself is not a possibility- there are multiple pieces of heavy/very large equipment). I told my landlord about this situation and he never responded. Now he’s asking me to pay for all of January. Do I have grounds to refuse this? My lease specifies that the landlord is responsible for maintaining parking areas and there’s an ordinance for snow removal on sidewalks, but I am having trouble finding one for driveways/loading docks/parking lots.
