At-fault Accident Without Insurance. Will I Go To Jail?

Card image cap

This was in Howard County, Maryland on the highway.

I got into an accident with another driver. I was at-fault. There was very very minor damage (rear-view mirror casing on both cars came off) and no injuries. The other driver said he would not press charges.

I am 22 years old and still under my dad’s car insurance. He had told me over the phone a couple weeks prior that there were some issues with my name staying on the policy, and that he would take care of it. But I did not think I straight up didn’t have insurance. I thought this was just an issue that hadn’t resulted in anything yet, but that did need to be taken care of promptly. I know this was irresponsible of me, I should have double checked myself somehow. Also, because I wasn’t the primary policy holder, all of the emails/texts regarding billing and cancellation inquiries were sent to him and not me, so this was the first I was hearing about any insurance problems.

Fast forward to the night of the accident, I find out my insurance was cancelled a little under a month prior. I had no idea, but was still charged with a knowingly driving without insurance citation, along with a few other small ones (however, the knowingly driving without insurance requires me to appear in court). I got insurance the very next day (which I have proof for).

I am very nervous for the court date and I am scared of facing jail time. How likely is going to jail in my situation? I also plan on getting a traffic lawyer.
