Attorney Neighbor Threatening To Sue If We Put Up An Already Permitted Second Fence On The Property Line To Meet Ca Pool Height Fence Law. His Fence Does Not Meet 5 Feet Tall Requirement.

A few weeks ago we started building a permitted fence on our property because we found out that our property did not meet CA pool fence regulations. For liability reasons we would like to secure our property. Our neighbor has two small children and pets (cat/dog) but he told us if we build a second fence he will sue for damaging his property value. We have already had the city come out to make sure we are not blocking his view and we plan to try our best to keep it out of his view. Our house is downhill from his house and there are hedges between the two properties. He has a fence on his side of the property line but it does not meet the height for our pool. Our city has a view ordinance in which you can’t block the view of the houses above you which includes buildings, trees and hedges. The city determines the view from inside the house and he has taken pictures at the property line outside. He has also threatened to cut his hedge down so he can get a better picture of our fence when it is built. Does our neighbor have a case? He told us he will file a claim once we finish building our fence. He told us not to follow the law. Is this something that we could report to the State Bar of CA for attorney misconduct or is this just as petty as his threat to sue us? He told us he can sue us and not pay any attorney fees and we would have to pay attorney fees and he would make it drag out three years.
