Basement Flooding After Having A Company Do $11,000 Worth Of Work On It
Purchased this home (late 2019) from my father and he had around $11,000 worth of perimeter drains and sump pump work performed by a company (mid 2019). The work is supposed to include a lifetime warranty. At the time my father was told that if he paid for this work to be done it should solve the flooding issues.
Shortly after he had the work done he sold the home to me, because he was out of town all the time caring for my grandmothers, and he needed to move closer to them. I'm not sure exactly how long after I purchased this house that we had our first flooding event. Might have been 2022. I was not aware that there was a warranty for the flood proofing system and I didn't have the money to have someone come work on it.
Basically anytime there is a strong rain system where there is a lot of heavy rain for several hours continuously there is some amount of water getting in. Sometimes just small amounts but up to a foot in some occasions. These extreme rain events have seemed to occur more often over the past few years unfortunately.
I recently was informed about the warranty and so I contacted the company to do a call back. The technician came and said a few things. 1. That they would redo their work on the drain system and see if that would fix the issue free of charge 2. He said it was likely that even if they do that we would still get flooding because the system was probably not built to handle the capacity of water that we are getting. 3. He said that if I only have them do the warranty work the first time and I dont (pay them upwards of $7000) to increase the capacity of the drain system that in the event that their warranty work does not fix the flooding i would then be responsible to pay them more than another $1000 on top of the $7000 to increase the drain system capacity.
I had a different company come give their opinions on what they would do to repair the basement. This company told me that it's pretty standard practice that if they or another company comes in and says the work they are doing will stop the flooding then at the point that their work was not sufficient it would be up to them at their expense to come in and make the necessary upgrades to the system to stop the flooding.
To me it seems like if we paid for this basement to be fixed and the work they performed did not fix it then what did we even pay them for? Them to experiment on our basement with a flood system that doesn't work.
If I cannot get them to fix this and or guarantee they will cover necessary upgrades to make sure their system works as expected is this something worth getting an attorney for?
