Boss Refused To Pay Me After Firing Me.

Card image cap

In short, I went to HR over sexual harassment after Boss buried the case. He told me directly that if I went to HR i would be fired. After the HR investigation ended he fired me. I worked in California, San Francisco btw.

On October 5th I was terminated. I was told my remaining shifts until the 9th would be fully paid for and that I wasn't allowed in the building. (Another coworker accused me of a crime because she had a crush on the guy who harrassed me.) Police got involved, I was proven innocent because Instagram memes aren't evidence for a crime. I had been fired before in CA and by law you receive your paychecks within 48 hours.

I received paycheck 1 on the 10th after I filed another report to HR for not receiving it immediately. A day later my work discount and app were deactivated and I received an auto generated email. Paycheck 1 was incomplete. I had gotten sick and injured and called off for 3 days. My sick hours were approved, and I got 2 of the 3 days covered. Coworkers were ignoring me after they found out I reported those guys to HR, and I couldn't find someone for the 3rd day. I sent an email explaining that I was very sick and requested they find someone on my behalf to cover me for the 3rd shift. Management agreed and approved the use of my sick hours for all 3 days.

The sick pay was not in paycheck 1. And I still haven't received paycheck 2 for the suspended week. I filed another report and received paycheck 2 two weeks later.

I received both paychecks on the same routine I would if I was still employed. But I was fired. My benefit account was deactivated. Boss made no attempt to contact me. No calls, emails, nothing.

Finally, almost a month after my termination I received a "separation notice" from HR. I filed another report with them because I was still missing 100$ in sick hours. Again, nothing.

Finally on December 10th, I received my sick pay. 2 months later.

Some additional context, I live alone. I have no family due to DV, and was on the verge of losing my home at the time after Boss cut my hours. He knew I would be homeless if I didn't receive my paychecks immediately, and I did end up losing my place because I didn't have the money when I needed it. 100$ may not seem like a lot but that was all I needed to be housed.

Unfortunately I have no evidence of my termination as it was verbal. I didn't sign anything or receive any traceable notice. I do have the bank transfers and proof I got my shifts covered, and approval of my sick hours. As well as the date my benefits were cut off (October 12th, only a few days after my last scheduled shift, the 9th) I read I could be entitled to compensation after he maliciously delayed my paychecks. What route do I take to get said compensation? I'm still dealing with health problems and recovering from injuries, that money would help me out a lot. It's not even about revenge or sending a message. I really just need that money, and he actually did intentionally try to keep my money for 2 months.

Any help would be appreciated, thank you.
