Bought A Condo Marketed With 3 Parking Spots, But Turns Out It's Only 2
My husband and I bought a condo back in 2020, and on Redfin/Zillow/MLS/etc, the description stated the property has 3 parking spots. 3 parking spots is almost unheard of in silicon valley, and it was one of the major contributing factors that led us to buy this property instead of others. Recently our HOA changed, and a placard was put up for one of the parking spots marking it as property of the HOA. We had no idea about this, our agent had no idea about this, and it may be possible the previous owners also had no idea about this. However, the HOA documents and title report have a map of the parking lot (albeit buried in the mountain load of paperwork that we had to sign and review) that only mark 2 of the parking spots as belonging to our unit. Now with 1 of our parking spots gone, it's become a big headache for us to continuously have to find street parking for the other car.
Is this something we can take to court? If yes, what would be the argument? false advertisement? QOL? something else?
