Boyfriend Drives A Truck Co-signed For By An Ex-girlfriend.

He has been making monthly payments of $582 for the last 2.5 years with no late payments to date.

Prior to breaking up a notary was signed by both parties with the terms:

• You are the sole driver as well as in charge of insuring the vehicle. • You will make monthly payments of $582, no later than the 10th of every month. • If all payments are made on time, you will receive the title once the loan has been paid in full. • If a payment is missed, I will keep the title, while you remain in charge of finishing out the loan. If for any reason you stop making the payments, I have the right to take you to court to receive the funds left for the vehicle.

She is now threatening to take him to court to get the truck out of her name since she is trying to buy a house and is being denied. She is sending old screenshots saying that his text agreeing to try to find a different co-signer is now a legally binding agreement that nullifies the previous notary.

She logged onto the account and made an additional payment last month and is showing that to PD saying she now owns the truck and has the authority to reclaim it. He has never missed a single month's payment since notary was signed April 2022.

She started harassing me and having her friends and family comment nasty things on my social media as well as posting the truck as "stolen" on all Facebook community pages and marketplace.

Does anyone have any legal advice on if she har valid claims? She is claiming the truck is in her name but there is still 20k left on the loan. Bank has the title. I will not co-sign for him after seeing this mess of a process and his credit is still too poor to refinance. Located in ND.
