Can A Property Owner's Association Require Payment By Paper Check?
As a member of a Property Owner's Association, we must all pay a special assessment for an emergency repair. This is on top of our usual monthly payments. We are in California.
Our POA specified that, unlike all previous payments, which have been done by ACH, they will only accept this payment by paper check. Any other payments will be ignored and we get a 10% late fee.
I am presently out of the country and do not have a paper checkbook, so I do not know how I could possibly fulfill this requirement. Is it legal for them to simply pocket my wire transfer and charge a late fee?
I don't even remember the last time I signed a paper check... it's ridiculous in 2025, but is it legal?
