Can I Charge My Sibling With Assault?
Both my sister and I are dependents in my mom’s household, however she is 18 and I am 19. She has always had a propensity for violence and has abused me for much of my childhood, however I have not been successful in gathering evidence because the times where it left wounds or bruises were when I was too young to have a phone. I would move out if I had the money to, but I don’t.
Onto the issue, my sister and I got in an argument about her blasting music in the kitchen at 10 am. I have insomnia and a circadian rhythm disorder so I sleep at abnormal hours a lot of the time. I asked her several times to just turn the volume down, but she refused, so I unplugged the Alexa she was playing it on and put it in my room. She retaliated by blasting the heavy metal even louder in her room with the door open (which is right outside my room). I tried to text and call my mom several times, but when she picked up she said to stop calling because she was at an appointment. After further arguing with my sister, I grabbed the speaker from her room and tried to put it in mine until my mom was home.
She decided to grab my hair and pull it to keep me from going anywhere while screaming into my left ear as loudly as she could (her voice was cracking). There isn’t any damage that I can tell, but it did hurt quite a bit in the moment. At that point she was calling my boyfriend’s name thinking he would side with her (she’s genuinely delusional). In defense, I tried to pull her hair to make her let go, and she instead dragged my hair down further so she could see the back of my neck and she bit it. My boyfriend then came out of my room after hearing me scream and verbally threatened my sister to let go, which worked. I then took photos (not sure if I can share them here) and have been in my room since.
Some extra info that may be relevant: - My mom bought both the Alexa and the speaker my sister was using and I was not intending to keep them forever, I was just trying to temporarily limit her ability to blast music. Neither items are damaged - When I grabbed my sister’s hair, I was only able to grab a very small amount of hair and I barely even pulled it before she yanked my head down and bit me - I did call her a bitch 3 times throughout the arguments (“why do you always have to be a bitch whenever mom leaves”, “you’re such a bitch”, “you’re such a f-cking bitch”) but otherwise did not insult her, use any instigating language, or threats. I don’t think I even yelled until after she bit me. - I live in Oregon
I have always wanted to charge her for the many things she’s done to me, because my mother has always enabled her psychotic behavior. So, I’m wondering if a bystander as a witness and a photo would be enough to charge her with assault. Thank you for any help you can offer.
