Can I Leave My Abusive Partner, Out Of State With Our Baby?
My relationship with my partner has been getting worse and worse, we have a 13 month old. I’m scared 24/7 for her and I. I’m not from where we live right now, I moved here with him because he wanted to be closer to his family. Our baby was born here. I have a job, family, and safety in my home state where I was pregnant.
Some people have told me I’m free to leave to safety, others say I can’t leave without his permission, but he will never give me that permission. I’ve tried.
My plan was to file for a temporary protective order, child support, and custody plan once I get to safety in my home state. I fear if I try to file it here, he will know and it will not be safe for us if he finds out. I don’t want to make the wrong decision and my daughter get taken from me. All im trying to do is protect her from this and I feel like I have no rights, no say, I’m trapped.
TL;DR - If I don’t have his written permission and I leave state with our daughter, could I get in trouble for “kidnapping” and could she be taken away?
