Can I Sue A Well Known Department Store If Their Employee Was Caught Filming Me In Dressing Room

I was a victim of voyeurism today at a well known department store. The man checking me in at the dressing room purposely switched out with the female attendant when he saw me approach, it was a slow day and I was the only one in the dressing room. While I am in there it had only been two minutes or so and am unfortunately wearing a dress so I had to fully undress to try on a top and clearly see in the reflection of the mirror, his phone sticking out from underneath the door filming me. I was in shock but I swung around and opened the door quickly so I could catch him. He was caught red handed and was trying to sprint away as I started yelling at him and to get his manager and that I was calling the police. The police came and eventually got him to admit to it. He is in jail rn for voyeurism. He apparently has no record prior to this. I consulted a lawyer and he made it sound like it would be hard to bring anything against the store but I want a second opinion. The managers said they have policies in place of men not being allowed in the ladies changing area and he was, and he was on duty at work as a dressing room attendant. Would that not make the store liable for what happened? They also said they video clearly shows him going in after me and showed him doing it to another girl right before me. Would love opinions on this as it was quite traumatizing and would like to sue for my distress.
