Can I Take My Daughter And Go To A Domestic Violence Shelter If I Have A Pending Domestic Violence Charge? Or Would It Hurt My Chances In Court, And They Would Take Her Away?

About a month and half ago my boyfriend tried kicking me out of the house naked so I obviously fought back because who wants to be outside naked? I did end up scratching him because he had grabbed me and pulled my hair and wouldn't let go so I scratched his arm, so he'd let loose. Eventually I got some clothes on and ran to my car. I left our daughter inside with him because at that point I just needed to get out and safe. I called the police to report the incident (not to get anyone arrested) so that he could not say I just left and abandoned her if we went to custody court. I also got a video of him dragging me to the door to kick me out while I was naked. Long story short they ended up arresting me for scratching him. He ended up bailing me out but I feel stuck to stay because I want to be able to tell the judge we are together and working through things, so I don't get charged and also i'm scared if I do leave either i'd have to leave my daughter or they'd take her from me and give him temporary full custody since I have pending charge. But the abuse just keeps getting worse by him and since he's tried to kick me out more times that I can count, he keeps pushing me around, raping me, pouring drinks on me and emotionally abusing me and I don't know how much of this I can take. the main question is can I take myself and daughter to a domestic violence shelter and be safe or would they take her away and it would make my case worse since we wouldn't be together anymore?
