Car Stolen

Card image cap

So my car was broken into about a month ago, the spare key was in the center console(I know), they obviously took that along with a few other small things. I hired a locksmith to come and make me a new key and delete the old ones since it’s a push to start, he said he could do that and did.(I have this through text) Two nights ago my car was stolen, I have a ring camera and they walk up unlock the car hope in it and drive off (with I’m assuming the key they got out of the car). I message the locksmith he said that that is impossible he deleted the old ones since there is no way to program a new key without deleting the old ones. It was recovered the next morning completely trashed and practically everything taken. So now to verify what locksmith said I took my car to Toyota and they took pictures so I have proof and told me that all 3 keys were still attached. I had them delete all keys and make me a new new one. Story times over now to my question can I sue this guy and if so should I give him the opportunity to make it right before actually suing which I wouldn’t even know how to do. I’ve tried contacting lawyers to even see if I have a case and no one willing to take my case without a $20000 retainer.

Since I already am going through insurance for all the damages done to my car I don’t want much from him, 1st a refund, then pay for the deductible for my car insurance claim and lastly replacement for the major things that were in the car and I would have to replace since my car insurance doesn’t cover personal property.
