Car Struck In Dirve-way By Heating Van

Just wondering what course or action, besides the usual insurance claim and police report, should I take for this bizarre scenario. Early tonight a neighbor knocked on our door to inform us an HVAC company truck backed into our driveway, smashed into our SUV, and then drove off. We then saw the truck across the street and were able to find the company phone number. I called to ask what the heck just happened and the woman on the line said she would deal with it. The driver then crossed the busy street and gave me his insurance and registration info, took photos, but then ran to fix the water heater across the street. The car was parked about 60-80 feet up our drive-way and was slammed into with a serious dent to the read door and broken all rear head lights. Much more damage than a bump you would expect.

But now we are down to one car. They haven't filed a claim with their insurance yet, so I called their provider to link a future claim to mine and the police report. But what we need is a replacement for the family car, the big SUV that transports our kids and dogs to school/various activities/everywhere.

Do we have any right to legal action to damage to private property and time/potential work loss?
