Child Support Mandated By The State. Wtf Do We Do?

So, I’m the mother asking for advice.

I have been with my boyfriend for 2 years. He receives Medicaid and food stamps for our son. He moved in with me right after the birth of our son in September. He was also diagnosed with Hodgkins Lymphoma Stage 4 in November. It has been a nightmare ever since. He has been unable to work since November as if he is far too ill. I am his full time caregiver and MPOA and DPOA.

He received letters in the mail stating that the state of Michigan is opening up a child support case against me to pay since he receives state aid.

When my son was born I inquired about adding him onto my work insurance, they want to charge $700/month which is absolutely not affordable for us! Especially with his cancer and only my income. Clearly I solely provide for our family.

Today I was contacted by a process server and I will be served for friend of court papers tomorrow.

We don’t know if we should contact DHS to explain the situation, we aren’t married, our hands are completely tied. My boyfriend has also recently applied for disability. So we are waiting on that. But, this is obviously very nerve wracking. I’m a very hard working mom who is doing right by my family so the legalities of all of this are so beyond hard.

Is there anything we can do to get this case dismissed or explain anything? My boyfriend and our son need the benefits! TIA
