Clearing Ice From Parking Lots/sidewalks

Hi all,

I live in Bloomington, IN. On Sunday we had a big snowstorm with some ice, we were under a travel warning until yesterday afternoon when it changed to a travel watch. My apartment complex’s parking lot has been marginally plowed, but the majority of the parking lot and sidewalks are straight ice. Our property management company did not salt the lot or sidewalks before or after the storm, and when my roommate called to ask, they said they can’t get all of the parking lot so they don’t salt any of it.

Obviously it’s impossible for us to drive anywhere, but we have also both slipped and fallen while just trying to walk to work.

My question is, do landlords/property management companies have a legal obligation to clear ice from their sidewalks and parking lots to keep tenants safe?

This is what my lease says: “Resident shall hold the Landlord harmless for any water, storm, flood, or fire damage to his personal property. It shall be the responsibility of the Resident to carry renter’s insurance to cover any and all personal property within the demised premises or within the storage areas provided by the Landlord. It is expressly understood that Landlord does not maintain insurance to cover Resident’s personal property or personal injury. Landlord is not responsible to any Resident, guest, or occupant for damage or loss of personal property or personal injury from (including but not limited to) fire, smoke, rain, flood, water and pipe leaks, hail, ice, snow, lightning, wind, explosions, earthquake, interruption of equipment functioning or of any services or utilities, theft, negligence of other residents, occupants, or invited/uninvited guests or vandalism unless otherwise required by law.”

If they are legally required by local, state, or federal law to clear ice, does that override the lease? (Also, if this is relevant, I do have renter’s insurance).
