Closing On Sale Of My Home In Ga, Closing Attorney Withheld $5300 For A $4200 Lien, But Did Not Pay It And Did Not List It On The Closing Docs. After 1 Year They Still Haven’t Paid It And Also Refuse To Give It To Me To Handle Myself.

Located in Georgia. During the closing on the sale of my home, a $4200 lien was discovered the day before the closing. At the closing the next day, the buyers attorney explained it and said it would be withheld from my payout from the sale and they would disperse the payment to the city to satisfy the lien. They withheld more than the lien ($5400) and have not been able to explain what the difference is for although I’ve asked multiple times. The house has since changed ownership twice, even with the unpaid lien. The closing docs have no mention of the $4200 lien, nor the mysterious $1300 additional funds withheld. I’ve spoken to the buyers and the closing attorney multiple times over the past year since the closing. They keep promising to pay it directly, but they still have not. I check in with the City every month or so to see if it was handled and to date it has not. I’ve also asked the attorneys office to issue the check to me and I will go pay it since it is in my name, but they state that the check has to be written to the City since they are the ones that filed the lien. I’ve spoken to the attorney on the phone, emailed them, and in person, but it has made no difference. They promise to handle it just to make me go away and then they seem to never give it a second thought. 1) if the lien and “mystery” charge are not on the closing docs, wouldn’t they be required to issue a check directly to me? 2) what can I say to them to get them to issue me the check so that I can handle it myself once and for all? 3) should I report the closing attorney to the Bar Association? They’ve made promises that it will be taken care of, I am at the point that I know it will not be handled by them. They’ve given me the runaround for a year. I filed a police report months ago, and spoke to the GBI who is advising the police on the case. They recommend that I try to get the money back myself first, and to hire an attorney, but I am not in the position at the moment to hire my own attorney. There is a lot more to the whole ordeal, but this part I have been trying to resolve for a while and could use some advise.
