Disabled Daughter
I desperately need some help/guidance. My daughter is the defendant in a civil custody case over her son. She is 18, but has an autism diagnosis and does not have the cognitive ability to navigate the court system and/or properly defend herself. The father of her son also has cognitive delays but has been provided an attorney by his parents. That attorney is adamant in court about me (her mother) not having any legal ground to speak on her behalf or represent her. I understand this is legally accurate. I am filing an emergency petition for custody of her on Monday, but the hearing she’s scheduled for is on Thursday. Is there anything that protects her legally? The opposing attorney and the judge are both aware of her disability and cognitive delays, and yet they are allowing a hearing to take place without her having any representation whatsoever and will not allow me to speak on her behalf. Please help ????
