Dmv Trying To Suspend My Husband’s License Due To A Collision — But He Wasn’t Driving

First post here, please bear with me.

In November my husband’s (off, empty, parked on our property) truck was totaled in a hit-and-run where the driver fled on foot. The car they were driving was stolen and towed away. As far as we know, police did not find the driver.

Today we received mail from the DMV stating my husband’s license will be suspended for 5 years or until we file an accident/collision report, citing this law: https://oregon.public.law/statutes/ors_811.720

Should we truly have reported this?
