Ex Got Dui With Kids In The Car

My ex had been sober for 7 years. We split a little over a year ago. I learned that he had resumed drinking 2 weeks ago. He may or may not have started back up earlier, but I have no evidence either way.

Two weeks ago, he was so drunk, he couldn't stand up while alone with our 7 and 4 year olds. I didn't have a car. My sister had to go get them. We have joint custody.

I know how he used to be. He drives drunk. He stays drunk for days. I'm scared. I called cps. I showed them the videos of him being drunk out of his mind and his home being filthy. He wouldn't let them in the house so they said there was nothing they could do.

Last night, I discovered that he was pulled over for a dui with my kids in the car on Saturday. My friend stumbled on the arrest report. I wasn't notified by anyone.

I'm supposed to have the kids tonight. I'm calling the local cps office as soon as they open. I don't have lawyer money right now and I don't know if my lawyer will help. Can I go get a tpo that prevents him from taking the kids from school? Can I refuse to give them back to him?

What can I do to protect my kids before he winds up killing them?
