Exwife With A History Of False Allegations Has Accused Me Of "revenge Porn" In Divorce
She has twice before falsely accused me of domestic violence and neither time resulted in any arrest charges. She actually had to meet my PO and admit to lying to the police. Now we are in divorce and she has accused me of "threatening" to share old sex videos with her new BF. She has not said that I did actually share intimate material; only that I threatened to. This was enough for her to finally get me arrested. I was able to fight extradition and bond out. Now I get to fight this case. So my questions are:
She has nothing but a cherrypicked google photos conversation. I specifically state in this conversation that I would never share any of that material as it was for my own private satisfaction. Never do I ever hint or suggest that I would share this material. She stated in the affidavit that I specifically mention her affair partner by name and one specific video, and a threat a show him. This is a complete fabrication and the entire conversation will illustrate exactly my contradictions to her claims. So she has perjured herself in the affidavit. and it's definitely not the first time she's lied to police to harm me. She's financially incentivized to make this complaint now. She has no damages of any kind and merely using this as leverage in the divorce. I was arrested 24 hours after receiving a letter from her attorney stating that she wants a $50k divorce settlement.
So how does this case of hers even exist? Obviously, I'm researching criminal defense. I'm out on bond for this from a county 700 miles away in a different state. If this case had any merit at all; shouldn't it be here and not where she is? As that's supposedly where the "crime" occurred?
I feel pretty confident about my chances here because #1; I didn't do what she says I did and there is no evidence to the contrary. #2; there are no damages she has incurred here. Typically, you would see something like this as a quid pro quo situation. Either she complies with ______ or I share sex videos with her f*ckboy. But what is the blank? What was I supposed to recieve from this exchange? We're divorcing no matter what and reconciliation is impossible. I stand to gain nothing by sharing that video with anyone and it surely wasn't shared publicly.
So how does this even exist? Where's the crime? and isn't obvious that she stands to profit from it?
