Father’s Estate Going Through Probate. Do I Need To Take Any Action?
My father died earlier this year. He and I were estranged, and I was not a beneficiary of his trust. The only beneficiaries of the trust are my brother (who is the administrator of his estate) and the daughter of his ex-girlfriend. My father was not married at the time of his death, and my brother and I are his only children.
He has one account which was not named in the trust and is going through probate. My brother has hired an attorney to take care of this, and I know I was listed in the filing as one of my father’s surviving children.
Given that I was not a beneficiary of my father’s trust, I’m wondering whether I should take any action to increase the chances of receiving a portion of this account. Will the fact that he deliberately left me out of his trust matter when the judge is deciding how to divide the assets of this account? Should I consult with an attorney about this?
