Fight Over House In Texas Divorce, Wife Can't Afford It

Card image cap

I make significantly more than my wife and we both want to keep the house after the divorce. She has great credit, but her income is far too low to take on a loan or mortgage on her own. She claims that the court is likely to give it to her since she's the "primary caregiver" of the children.

Has anyone else been in this situation? I've read that a judge might award it to me since I can easily refinance it or get a loan to buy her out, making it the easiest and most practical solution. Then again, I've read that they'll often give the home to whom they deem the primary caregiver, but I don't see how that would work since she couldn't afford it, even with child support (Texas isn't an alimony state).

I do have an attorney who is working on this. Just curious if anyone else has been in this situation before and what happened.
