I am having a hard time with getting leave through work. I am having surgery, and told my workplace in November that I would need to take medical leave. To make a long story short, I followed up multiple times, and didn't get leave forms until two weeks to my surgery. My surgeon completed the forms I was sent, but I saw upon them returning them that the forms I was given was for family leave, and not for my own personal medical condition. I asked my HR representative to send the correct forms, and three days later, she again sent the wrong forms, before sending the correct ones. My boss has made me aware that my leave will not be processed until I get my correct forms in, but my surgeon office has not returned them yet, likely due to dealing with other miscommunication with various offices reguarding my surgery that they have been awesome in straightening out for me. My question is, can they really deny me leave and prevent me from getting my surgery even though I gave them almost three months to get these forms to me? Can I lose my job for going even though I have not been approved? What are my legal options?
