Found My Stolen Car For Sale, Police Won't Report It Stolen
Update to this thread: https://www.reddit.com/r/legaladvice/comments/1grq6pp/purchased_a_car_that_is_now_missing_from/
I will keep it concise point form:
- after the above thread a lawsuit was filed against the dealer, after filing I located the vehicle for sale online
- I found the car for sale in California at a dealership, it is 100% the same vehicle, VIN has not been altered, since the car was not reported stolen initially the person that stole it through shipping had it re titled
- Flew to CA and spoke to the police located in the same county as the dealer, showed all paperwork, title bill of sale etc, they were ready to seize the vehicle but they just needed to have the vehicle reported stolen in the jurisdiction it was stolen in. The vehicle was purchased by the CA dealer from a large auction house in the US
- As noted in the previous post the car was unable to be reported stolen in FL since the dealer gave the keys willingly to the shipping company so it is "not stolen" according to them (I have learned it is very difficult to report a vehicle stolen if it is done through shipping companies, which is why these scams are at a all time high through central dispatch)
- The shipping company that originally picked up the car delivered the car to the thief in TX
- I now have contacted the county police where the car was delivered in TX, they are willing to take the report I just have to fly out in person with papers, I feel if I do this it is still not guaranteed, if they do report it stolen then great, I get my car back
I guess my question is, is there any other way to get this vehicle back that I technically own and paid for? It seems no matter which way it goes the thief just gets away with it, FL and CA won't report it, I will try TX hoping for the best but if that fails then there is no winning. The new dealer bought the car legitimately from the auction house, the auction house bought the car from the thief but he had the keys and got a new title issued.
Lawsuit is filed however the car is 100k+ instead of paying lawyers the bulk of the value of the car i'd rather have the car back and then sue for damages.
Any advice is appreciated
