Friend Was Fired After Having A Stroke At Work
My friend is a truck driver who works nights. He had a small stroke at work 7 months ago (while on break/not driving) and has since made a full recovery. The company he works for told him that since it's considered a health condition that he couldn't apply for worker's compensation and instead he had to apply for FMLA (leave) and short/long term disability. Last month they cut his health insurance on a Wednesday and on that Friday they told him he was fired. Truck drivers have a 12 month mandatory waiting period to get back to work if they have a stroke. Does he have a case for wrongful termination or is he SOL?
