Garishment Processors And Employer Liability.

Card image cap

In a nutshell: a debt collector got a default judgment against me for something I didn't know about until the garishment against my payroll started to get collected. I tried to fight it but there is what seems like a complex legal navigation ahead of me. A hearing is scheduled for 2/18/2025. In the meantime, the 3rd party garishment processor my employer contracted with (OVS) collected the ENTIRE amount of the judgment from ($2k) last year (Dec 2024). Last week, I was notified by my employers NEW garishment 3rd party processor (ADP) that they were going to begin garishment with the SAME paperwork provided to the previous processor, which would result in my salary to be withheld DOUBLE the amount of the already collected judgement. ADP, advised me that the only way to release the upcoming new garishment is to have an order to release it from the 3rd party or the court. Is this even legal? Any info, resources, strategies for handling this is greatly appreciated and welcomed! Please and thanks!!
