Getting Sued By Big Name Credit Card Company.
WA state - A couple years ago I had medical issues that prevented me from working and took up the entirety of my FMLA plus some and spent the entirety of my PTO and Sick Time. I spent my entire savings keeping up with bills until I couldn't. When I was released to work I tried to get back onto the same company but they couldn't/wouldn't work with my availability. Needless to say I've been out of work/unemployed for over a year. This is mostly due to unaffordable childcare/unavailable childcare. So I've been a SAHM. During this time bills were piling up, but all my extra money went to taking care of my child, keeping a roof over our heads and food in the fridge, I have no money left over and sometimes even less.
While I was working I was making a good deal of money and took out a loan for a car and also used big name credit card (BNCC) to pay for plane tickets to visit family in another country to help build my credit. I obviously intended to pay these debts before my medical issues happened but now I've been sent to collections for the medical debt I couldn't pay off and I'm being sued by BNCC (one I used to buy plane tickets) for not paying off said credit card which I stupidly maxed out to pay for groceries when I was unemployed thinking I'd just pay it off when I got a job.
I'm wondering what my options are. My child's father is a cosigner on the car and has kept up with payments so the car is not in default (we still owe $15,000 and are not married), but I have about $5000 in medical debt and $3000 to BNCC company. The medical debt has been sent to collections and BNCC is actively suing we have a court date in about 2 months. I thought of filing bankruptcy but I cannot afford a lawyer and according to the documents sent to me by the NWJustice Project I don't think I can. It says I shouldn't file bankruptcy if: 1. You're unemployed (right now I am) 2. You do not have assets that creditors can take (I don't know if the vehicle counts, but other than that I rent, have $0 in savings and an average of $5 in checking after bills) 3. Your income is protected from garnishment (I live below the poverty level in 2023 made ~$6000 and looking like I'll be making about that this year)
What are my options? What should I do? Any advice would be super helpful. My anxiety thanks you.
