Getting Sued For Homeless Dying At Side Of Shop

So my wife owns a donut shop. This week (Monday) she had a delivery for the shop. So they have a side alley that delivery’s get wheeled through. In this alley homeless people sleep all the time. She will ask the homeless to move and let the man through this has happen many many times. This last week same thing happen but he didn’t move so the delivery went by the side of him and just did his delivery as usual. That night a wellness check was made on him and it turns out he had died. The family came by today and told her they are suing her because he died there and she didn’t call anyone. Even though cops have asked her not to call them for homeless people unless they are violent or messing with their business. This seems like such a frivolous lawsuit and told her she should counter sue for waste of time. Does she need to worry? Or is she going to need to pay up? Thanks for any advice
