Got Hit By A Car On Christmas

I’m new to this sub but wanted to post seeking any guidance or tips as I deal with my situation.

TL;DR : In NJ - got hit by a car as I was taking my son out of the car seat. Vehicle struck me and my parked car. Some injuries but overall OK. Driver did not have headlights on.

On the evening of Christmas. After I parked my vehicle on a resident street. I proceeded to take my 1 year old out of the back left car seat. Back left door was swung open and I was leaning in to remove my son. A second later a vehicle without their headlights on struck me and smashed right through the open door.

The car must have turned the wheel last second so I got hit as the tire was on an angle and the front bumper/fender dragged across my shin/leg. Tire went right over my foot. I have some cuts/bumps/bruises on my legs and the force of impact pushed me into my car’s frame slamming my face into the car. Laceration on nose and bruising on nose and cheek under right eye.

My 1 year old, 3 year old, and wife were all in the car with seatbelts on. My car was still running so taillights and interior light was on.

Driver who hit me was elderly and did not have headlights on (we have ring video of them driving without headlights seconds before hitting us). Cops came, EMT checked me out. Everyone was OK thank god but I have some leg, face, neck pain. I went to the ER the next day, got a CT scan which came back good nothing fractured or broken.

Cops let driver drive home after.

I started claim with my insurance. Still waiting on police report because everything is slow and people are out due to holidays.

My car is pretty messed up and not drivable, my wife and kids are still shaken up. I’m not sure what I should do from a legal perspective so posting here. Thanks
