Got Hit By A Drunk Driver

I recently got hit by drunk driver in another state while visiting family. I was a in the front passenger seat with one of my family members being the driver. The drunk driver t-boned us on the driver side while we were waiting at a red light. I also just turned 18. Knowing this, I figured that both said family member and I had cases against the drunk driver (separate claims). My family member is going to go forward with an attorney, however I just want to make a claim against their insurance and get it over with to cover checkups/prescriptions and what not. The car wasn’t mine so I’m not going to take any property damage. This family member however seems to be withholding information about insurance and the police report, and seems to have a desire to have his attorney represent me against my consent (no contact or documents signed). They instead request that all my healthcare information be sent to them. I am back home in another state now, so it’s not like I can just swing by the police department. Is what my family is doing legal? How should I go forward with this situation?
