Guy Tried Breaking Into My House, Broke Part Of The Door Frame.

Strange thing happened just now. This guy tried kicking down my door at about 3 am.

Wife wakes me up, someone's banging on the front door. I tell her to get the kids in one room and go to the front door:

He says, "Let me in, I know you're in there."

I say, "Who are you?"

He says, "You know who this is Chucky, now let me in" KICK KICK.

I say, "I don't know you, this isn't Chucky, get off my property."

"Don't fuck with me Chucky." KICK KICK

"If you don't leave, I'm calling the police."

"The hell you are." KICK KICK

"I'm armed."

"Don't make me laugh." KICK KICK

I get on with dispatch. I say some guy is trying to break into my house. I don't know him. Send someone.

He says, "Who you talking to, let me the fuck in Chucky!"

"Get off my property!"

Dispatch stays on with me. They hear a couple more exchanges as I tell him to leave and he indicates he's not going to. I narrate his movements.

He starts to go around back. There's a window in the back you can see through. He sees me clearly. I see him clearly. Big guy about 35. He bangs on the window.

"Stop fucking around Chucky!" he says. BANG BANG

"Get off my property!"

He goes around the side of the house. And bangs on the side of the house where the children are.

BANG BANG.

BANG BANG

He comes round to the front door again. The police show up about 4 of them. I listen to their whole conversation, through the window.

He claims some guys sent him to this house for a party. He acts surprised and annoyed. He provides them with ID. They offer to give him a ride to his Dad's house. Apparently he took an uber here. We live on a somewhat rural road. Neighbors are all asleep as well. Quiet, family area. Again the guy is 30-35.

My lights in the house were off. There's no indication of a "party."

I talk to the cops afterward, they say it was a misunderstanding.

"I told him clearly to leave and he didn't."

"It was cold, he thought some guys were messing with him."

I point out that I was very clear in telling him to leave and he didn't.

"Did he cause any damage?"

I point out the long crack in the door jamb, about 3 feet long where he was kicking.

"Well I can summons him for the door frame if you want but he had a couple of beers and was just confused."

The officer didn't seem interested in writing a report until I pointed out the door frame. After that point he said he would "do a report."

I took his information and said I would call him tomorrow.

I'm just not sure what to think about this. He almost broke my door down, Fix won't be too bad though, I have almost all the tools and materials to do it already, will probably cost me 20 to 40 bucks but I'm more annoyed at the scene that was created and how frightened my children and wife was, and the fact that I told him to clearly get off my property and he didn't. When I said this to officer he said, "We can do something about the door jamb but there's nothing to do about the trespass."

Should I pursue the summons on the "vandalism" (the door jamb) as the officer described it? Why is there nothing they can do about the trespass? In MA.
