How Slowly Can An Executor Proceed Before You Can Do Something About It (ma Us)
This isn’t a huge issue currently, but I would like to get a sense of what might happen. One of my siblings was appointed executor of my last surviving parent’s estate in May of 2024 (death was in February). To this point she has completed some of the work, but has recently been saying that she is too busy to do anything further, and has no idea when she would have time in the future. The complicating part of this is that she has been living our parents’ house for 6 or so years. She really doesn’t have another place to go until the house is sold, and the estate is split between the siblings. She also isn’t able to work much. As it stands, the balance of the estate is probably only $50 k, but the house has a value of $400 k or so. It is in disrepair at this point, and I’m sure it’s getting worse by the day, since she’s not performing the required maintenance and is something of a hoarder. The rest of the estate would go pretty quickly if she continues to live there and uses the money for general operation of the house (taxes, utilities, fuel oil). I’m curious what the application of the law is in MA regarding such a case. She has a vested interest in having this take as long as possible. Thanks for any information.
