How To Get Rid Of Illegal Guests Turned Residents?

Card image cap

I'm currently living in an apartment in Berkeley, with two other tenants. My roommate's family has moved into the unit on multiple occasions, violating the lease every time they stay.

The lease states "Occupancy by guests for more than ten days in any six-month period is prohibited without Landlord’s consent and shall be considered a breach of the Agreement." The lease only permits for 3 tenants, no more, no less.

The first time her family moved in, it was just her mother, who lived in the unit for 2+ weeks. I had multiple correspondences with real estate management, including a request to switch units, due to the amount of emotional distress they caused me. The mother of my roommate was verbally abusive on multiple occasions, having yelled at me over issues including cabinet space. To explain how frivolous these situations were, here's an example of the first time I was screamed at: She told me I was taking up too much cabinet space and the apartment was for 3 people. When asked, she could not define what 1/3 of cabinet space was.

The second time her family moved in, it was her entire household during the Thanksgiving break. This time, they moved in with a ridiculous amount of kitchen appliances, three luggages and brought multiple chairs, a spinning table top (think: the type of turning thing used at a Chinese restaurant at a large table), filled the entire fridge with 20+ types of sauces and food, etc. Countertops were filled with their kitchenware, boxes of their stuff were littered across the floor, the living room stored their luggages and bags and the sole couch became my roommate's mother's bed. The other tenant wanted to have guests over, but couldn't, because they had moved in.

When informing apartment management about the situation, they sent my roommate a warning. My roommate's mother's immediate reaction was to accuse my mother of reporting her for moving in, screaming "**** YOU" on repeat at her, until my mom left to talk to the leasing office. The illegal residents left the same day they were reported, having stayed for at least a week.

Now, they're staying over for a third time, having moved in an additional large cabinet that sits in front of the dishwasher. I've been talking to management to remove them, since they've breached the lease multiple times. In the meanwhile, I've been told that the police can't get involved unless the illegal residents physically attack me and/or harass me.

Is there anything I can do, as a co-tenant, to remove these illegal residents from the apartment? I don't want to deal with them due to their consistent aggressive behavior and I am paying rent to live there... If they're not paying rent, why are they allowed to stay and use the apartment as if it's their own home?
