Husband Took Off With Truck.. Trying To Get A Divorce

This is in California.

So. My husband took off with my truck and blocked me in all forms of contact. I have no idea where he is where he works. Who he’s friends with.. nothing.

This is multilayered. There is a history of DV which I am working on getting the timelines written out along with my photo and screen shot evidence for the police reports. I also need a restraining order from him. However, the cop I spoke to told me it’s almost pointless since they can’t serve him with the order.. since I have no address or contact info for him

Yes. He DID have a phone. But I suspended the line. Why would I pay for a phone he blocked me on?

Ok next thing. I need a divorce. Again.. how do you serve papers to someone unwilling to be contacted or found?

I can not get an automatic judgement. Because he took off with my truck. Yes the truck was purchase WHILE we were married. But I do not believe it’s community property. My mother and I co own the truck and have an on going loan on it. I haven’t had a job this entire time we’ve had the loan (as I recently went back and finished school). Also have not had any money. My mother has made every payment for this truck including the down payment. So no marital funds have EVER been used for this truck.

Also. Only my mother and I are listed on the insurance and loan for the vehicle.

I will be seeing a lawyer next week. But I am requesting if anyone has any advice on how to handle this situation.

Edit: prior to him blocking me I very clearly told him he must return the vehicle to me or I will be reporting it stolen. To no avail obviously
