I Am Being Harassed At Work But Hr Says We Are Both At Fault
I thought my relationship was OK with this particular person at work. But I heard him complaining about me in the Cafe, nothing unlawful the first time. Sometime later, I get a text from a coworker that the suspect made disparaging comments about my English accent (I am in California as an immigrant). The suspect tried to do an impersonation and mock an Asian accent.
A week later, I stepped away from my computer briefly. When I came back, someone wrote "my name big ****" in 64 point, bold font. It was written on a notepad like program. I was really rattled, I knew it could only be one person. I am on good terms with other. He also constantly tries to fist bump me trying to taunt me, which I ignore.
His behavior has progressively gotten worse. After these incidences, I stopped talking to this guy and reported to manager/HR. However, manager/HR took six weeks to do an investigation. The conclusion was that I am also at fault, simply because I do not return his "fist bump" attempts. I was given a write up.
I have raised all these issues in writing and in person. In writing, often times the manager/HR doesn't respond. Regarding my "Asian accent", manager told me it was not investigated for unknown reasons. The "my name big ****" came to a dead end. I tell them I can't fist bump, but they just insist and shrug.
After I reported to HR, one manager said that "I do not get along with peers", even though I am a technician trainer. They allowed me to work 60 hour workweeks for 19 consecutive weeks, but suddenly my OT is also denied. The manager even refuses to make eye contact with me, not even a Hi/Hello, but I am at fault for not returning stupid fist bumps.
At this point, I feel like I am being harassed by the guy and HR. Why is HR telling me to make unwanted physical contact? I am completely embarrassed and so confused.
